ARMTED LISTING POLICY

1. ABOUT THIS LISTING POLICY

This Listing Policy (“Listing Policy”) governs the creation, publication, display, modification and removal of listings made available through ARMTED.

This Listing Policy supplements the ARMTED Terms of Service and other applicable ARMTED policies.

Certain categories, including firearms, ammunition, regulated firearm components and other regulated items, may also be subject to additional rules, including the ARMTED Firearms Listing Policy and applicable regional requirements.

Where additional rules apply, you must comply with both this Listing Policy and those additional rules.

2. PURPOSE OF ARMTED LISTINGS

ARMTED listings allow eligible users and businesses to present items that they offer for sale.

ARMTED listings are intended for genuine sales offers.

Unless ARMTED expressly introduces another listing type, listings may not be used for:

  • wanted or “looking for” notices;
  • barter-only offers;
  • exchange-only offers;
  • giveaways;
  • requests to purchase items;
  • general advertising unrelated to a specific item for sale; or
  • other purposes unrelated to a genuine sales offer.

ARMTED may introduce additional listing formats in the future and may apply separate rules to them.

3. ARMTED IS NOT THE SELLER

Unless ARMTED expressly states otherwise in relation to a particular service, ARMTED provides the platform on which users and businesses may publish and discover listings.

ARMTED is not:

  • the seller of an item listed by a user;
  • the purchaser of an item;
  • the owner of the listed item;
  • a party to the sale agreement between users;
  • the agent or representative of the seller or buyer;
  • responsible for negotiating the sale;
  • responsible for collecting payment for the listed item;
  • responsible for delivery or shipment of the listed item; or
  • responsible for completing any legally required transfer of the listed item.

Any transaction arising from a listing is concluded independently between the relevant parties.

Users are responsible for determining the legal, contractual, tax and other consequences of any transaction they enter into.

4. ELIGIBLE CATEGORIES

Listings may only be published in categories made available by ARMTED.

ARMTED maintains and may modify its own category structure and may:

  • introduce new categories;
  • remove categories;
  • merge categories;
  • divide categories;
  • rename categories;
  • change category descriptions;
  • change category eligibility;
  • move listings between categories; or
  • restrict categories in particular jurisdictions or for particular users.

The existence of a category on ARMTED does not mean that every item within that category may legally be sold, possessed, transferred, shipped or advertised in every jurisdiction.

Users remain responsible for determining whether their item and proposed sale are lawful.

Where a more specific category is available, users should select the most appropriate specific category.

ARMTED may reclassify a listing where it considers another category more appropriate.

5. REGULATED ITEMS

Some items may be regulated differently depending on country, state, region or other jurisdiction.

This may include, without limitation:

  • firearms;
  • ammunition;
  • firearm components;
  • firearm accessories;
  • black powder;
  • primers or ignition components;
  • crossbows;
  • knives or other weapons;
  • tactical or controlled equipment; and
  • other regulated products.

The existence of such categories on ARMTED does not constitute a statement that the relevant item is lawful in a particular jurisdiction.

Listings involving firearms or other firearm-related regulated items may be subject to the separate ARMTED Firearms Listing Policy and regional compliance requirements.

6. SELLER RESPONSIBILITY

The seller is solely responsible for the listing and the item offered.

A seller must:

  • have the legal right and authority to offer the item for sale;
  • own the item or otherwise be legally authorised to offer it;
  • provide accurate and non-misleading information;
  • comply with applicable laws;
  • comply with applicable licensing or registration requirements;
  • correctly identify whether the seller is acting privately or in the course of business;
  • comply with all applicable ARMTED policies; and
  • ensure that the listing remains accurate while published.

Publishing a listing does not transfer any of these responsibilities to ARMTED.

7. PRIVATE AND BUSINESS SELLERS

Users must accurately represent whether they are acting as a private seller or as part of a trade, business, profession or commercial activity.

A seller who is acting in the course of business must not present a commercial listing as a private sale.

Factors that may indicate business activity may include, among other things:

  • regularly selling items for commercial purposes;
  • offering stock or inventory;
  • selling multiple identical or similar new products;
  • selling on behalf of a business;
  • using professional distribution or fulfilment arrangements;
  • using dropshipping;
  • acting as an intermediary in the course of business; or
  • otherwise conducting organised commercial sales activity.

ARMTED may reclassify a seller or listing as business activity where reasonably necessary.

ARMTED may also require a seller to use ARMTED Partners or another business-specific account or functionality.

8. DROPSHIPPING, INTERMEDIARY SALES AND THIRD-PARTY FULFILMENT

ARMTED does not require every seller to physically possess every item offered for sale.

Commercial sellers may use legitimate arrangements including:

  • dropshipping;
  • third-party fulfilment;
  • supplier inventory;
  • consignment;
  • authorised intermediary arrangements; or
  • other lawful distribution models.

However:

  • the listing must accurately represent the item and its availability;
  • the seller must have authority to offer the item;
  • the seller must not falsely claim physical possession;
  • the seller must comply with applicable law; and
  • business activity must not be presented as a private sale.

ARMTED may request evidence of the seller’s authority to offer an item.

9. ACCURATE LISTING INFORMATION

Listings must be truthful, accurate and sufficiently clear to allow users to understand what is being offered.

Information must not be false, deceptive, materially incomplete or misleading.

Where applicable, listings should accurately describe information such as:

  • manufacturer;
  • brand;
  • model;
  • variant;
  • condition;
  • quantity;
  • year or production period;
  • dimensions;
  • calibre or specification;
  • included accessories;
  • relevant defects;
  • modifications;
  • item status;
  • location;
  • seller status; and
  • any other material characteristic relevant to the sale.

Sellers must not deliberately omit information where the omission would create a misleading impression.

10. ITEM CONDITION

The condition selected or described in a listing must reasonably reflect the actual condition of the item.

Where an item is used, damaged, modified, incomplete, refurbished or otherwise materially different from a standard new product, that information must be disclosed where relevant.

Normal signs of use should not be concealed if their absence would materially affect a reasonable buyer’s understanding of the item.

11. PRICE

Every sales listing must contain a genuine selling price.

The price must reflect the amount at which the seller is genuinely offering the item for sale.

Listings must not use false or placeholder prices, including prices entered merely to:

  • attract attention;
  • manipulate sorting;
  • manipulate search results;
  • avoid price-based filters;
  • create an artificially low advertised price; or
  • force users to contact the seller to obtain the real price.

“Price on request”, “contact for price” or equivalent practices are not permitted unless ARMTED expressly introduces functionality allowing them.

Additional mandatory charges that materially affect the purchase price should be disclosed where required by applicable law.

A business seller remains responsible for complying with applicable price display, consumer and tax requirements.

12. PHOTOGRAPHS AND MEDIA

Images and other media used in a listing must accurately represent the item being offered.

For used, individually identifiable, unique, collectible or materially condition-dependent items, listing photographs should depict the actual item offered for sale.

Photographs must not:

  • materially misrepresent the item;
  • conceal relevant damage or condition;
  • falsely represent included accessories;
  • falsely present another item as the item being sold; or
  • otherwise create a misleading impression.

Business sellers offering standard new products may use manufacturer, distributor or stock images where they have the right to use them and where doing so does not misrepresent the product offered.

13. AI-GENERATED AND SYNTHETIC IMAGES

AI-generated, heavily altered or synthetic images must not be used in a way that causes users to believe that the image depicts the actual item for sale when it does not.

In particular, synthetic media may not be used to:

  • hide the actual condition of an item;
  • fabricate features;
  • remove defects;
  • show accessories that are not included;
  • falsely depict a unique or used item; or
  • otherwise materially misrepresent the offer.

ARMTED may remove or require replacement of misleading images.

14. RIGHTS TO LISTING CONTENT

Sellers must have sufficient rights to use all content included in their listing.

This includes:

  • photographs;
  • videos;
  • descriptions;
  • graphics;
  • logos;
  • product materials; and
  • other protected content.

A seller may not use another person’s photographs, descriptions or other content merely because the material is publicly available online.

Business sellers using manufacturer or supplier materials are responsible for ensuring that they have any rights or permissions required for such use.

Use of listing content is also subject to the ARMTED Copyright and Intellectual Property Policy and the licences granted under the ARMTED Terms of Service.

15. EXTERNAL LINKS

A listing may contain a link to an external website where ARMTED permits such links.

Any external link must be directly and genuinely related to:

  • the specific item offered;
  • the relevant product page;
  • the seller’s store page containing that item; or
  • information reasonably necessary to understand the offer.

Listings may not use unrelated links primarily to:

  • generate unrelated traffic;
  • promote unrelated services;
  • distribute spam;
  • redirect users deceptively;
  • collect credentials;
  • distribute malware; or
  • otherwise misuse ARMTED.

ARMTED is not responsible for external websites or transactions conducted outside ARMTED.

16. DUPLICATE LISTINGS

Users must not create multiple listings for the same individual item primarily to increase visibility, manipulate search results or occupy additional placement.

ARMTED may remove or consolidate duplicate listings.

Business sellers may sell multiple units of the same product through a single listing or through inventory functionality made available by ARMTED.

Where ARMTED provides dedicated inventory, variation or quantity functionality, sellers should use that functionality instead of creating misleading duplicates.

17. PROHIBITED ITEMS

The following may not be listed on ARMTED, regardless of category, except where ARMTED expressly allows a narrowly defined lawful category:

  • stolen goods;
  • goods obtained through theft, fraud or other unlawful activity;
  • counterfeit goods;
  • unauthorised replicas that unlawfully infringe intellectual property rights;
  • illegal drugs or controlled substances offered unlawfully;
  • pornography or sexual services;
  • human remains or body parts;
  • illegally traded wildlife or products derived from protected species;
  • stolen credentials or account access;
  • malware or malicious software;
  • fraudulent, forged or unlawfully offered identification documents;
  • goods whose sale is prohibited by applicable law;
  • items offered as part of fraud, money laundering or other unlawful activity; and
  • other prohibited items identified by ARMTED.

This list is not exhaustive.

18. EXPLOSIVES

Listings for explosives are prohibited unless ARMTED expressly introduces a specific category and expressly permits a narrowly defined item under separate rules.

Users may not list:

  • explosive devices;
  • bombs;
  • grenades;
  • improvised explosive devices;
  • explosive charges;
  • unlawful explosive materials; or
  • other items whose primary purpose is explosive detonation,

subject to any specific exception expressly introduced by ARMTED and applicable law.

This rule applies independently from the Firearms Listing Policy.

19. STOLEN GOODS

Users may not list items that they know or reasonably should know are stolen, unlawfully obtained or subject to another person’s ownership rights without authority.

ARMTED may remove a listing where there is a reasonable basis to suspect that an item is stolen or unlawfully obtained.

ARMTED may also request evidence concerning ownership or lawful authority to sell.

20. COUNTERFEIT GOODS

Counterfeit goods are prohibited.

Users may not offer items that unlawfully imitate or misuse:

  • trademarks;
  • branding;
  • logos;
  • certification marks;
  • product packaging;
  • serial markings; or
  • other protected identifiers.

Replicas, reproductions and historically styled items must be accurately described and must not be presented as authentic originals.

21. MISLEADING OR FRAUDULENT LISTINGS

Listings may not be used for fraud or deception.

Prohibited practices include:

  • offering an item that does not exist;
  • knowingly misrepresenting ownership;
  • materially misrepresenting authenticity;
  • materially misrepresenting condition;
  • deliberately using incorrect photographs;
  • impersonating another seller or business;
  • directing users to fraudulent payment pages;
  • phishing;
  • requesting payment for unrelated purposes;
  • intentionally misrepresenting availability; or
  • any other deceptive practice.

ARMTED may immediately restrict accounts associated with suspected fraud.

22. CATEGORY MANIPULATION

Listings must be placed in an appropriate ARMTED category.

Users must not intentionally select an inaccurate category for the purpose of:

  • avoiding restrictions;
  • avoiding verification;
  • avoiding additional policies;
  • avoiding regional compliance controls;
  • obtaining higher visibility;
  • avoiding moderation;
  • reducing fees; or
  • otherwise circumventing ARMTED systems.

ARMTED may change the category of a listing without requiring the seller’s approval.

23. AVAILABILITY

Listings must relate to items that the seller genuinely intends and is reasonably able to offer for sale.

If an item:

  • is sold;
  • becomes unavailable;
  • can no longer legally be offered;
  • is withdrawn from sale; or
  • is otherwise no longer available,

the seller must promptly mark it as SOLD, UNAVAILABLE, remove it, or use another availability status provided by ARMTED.

Sellers must not intentionally leave unavailable listings active in order to attract enquiries for other products.

24. VERIFICATION AND ADDITIONAL INFORMATION

ARMTED may request additional information in connection with any listing.

Depending on the circumstances, ARMTED may request:

  • additional photographs;
  • video evidence;
  • proof of ownership;
  • proof of possession;
  • proof of authority to sell;
  • manufacturer or model information;
  • serial or identifying information;
  • identity verification;
  • business verification;
  • licence or permit information;
  • invoices or purchase documentation;
  • proof of authenticity;
  • evidence concerning item condition;
  • evidence of lawful origin; or
  • other information reasonably relevant to the listing.

A request for additional information does not mean that ARMTED assumes responsibility for verifying the item.

Failure to provide requested information may result in restriction or removal of the listing.

25. ARMTED VERIFICATION DOES NOT GUARANTEE A LISTING

ARMTED may provide verification or review features for users, businesses, firearms or listings.

Any verification, review, badge, status or moderation decision by ARMTED does not constitute a guarantee of:

  • ownership;
  • authenticity;
  • legal status;
  • legality of sale;
  • legality of possession;
  • condition;
  • safety;
  • quality;
  • value;
  • completeness;
  • seller authority;
  • buyer authority;
  • future conduct of a user; or
  • successful completion of a transaction.

Users remain responsible for conducting appropriate checks before entering into any transaction.

26. PROMOTED LISTINGS

Eligible listings may be promoted through paid ARMTED services.

Promotion does not:

  • exempt a listing from this Policy;
  • guarantee continued publication;
  • guarantee any commercial result;
  • prevent moderation;
  • prevent removal;
  • constitute ARMTED endorsement; or
  • establish that the item is lawful or authentic.

Promoted listings remain subject to all ARMTED rules.

If a promoted listing is removed because of a policy or legal violation, refund rules are governed by the ARMTED Paid Services Terms.

27. MODERATION

ARMTED may review listings before or after publication.

ARMTED may take action where it considers such action reasonably necessary for:

  • legal compliance;
  • user safety;
  • prevention of fraud;
  • platform integrity;
  • protection of users or third parties;
  • enforcement of ARMTED policies;
  • compliance with third-party platform requirements;
  • prevention of abuse; or
  • other legitimate platform purposes.

ARMTED may act on its own initiative, following a user report or following information received from another source.

28. ACTIONS ARMTED MAY TAKE

ARMTED may, subject to applicable law:

  • refuse publication;
  • request changes;
  • require additional information;
  • change a category;
  • modify technical presentation;
  • limit visibility;
  • remove promotional status;
  • temporarily suspend a listing;
  • remove a listing;
  • restrict a seller’s listing privileges;
  • restrict particular categories;
  • suspend account functionality;
  • suspend an account;
  • terminate an account; or
  • take other appropriate action.

ARMTED is not required to publish or continue publishing any particular listing.

29. NO RIGHT TO CONTINUED PUBLICATION

The ability to create a listing does not create an unconditional right to have that listing published or continuously available.

ARMTED may restrict, suspend or discontinue listing functionality or particular categories where reasonably necessary and subject to applicable law.

This may include changes resulting from:

  • legal requirements;
  • regulatory changes;
  • geographic restrictions;
  • safety considerations;
  • platform policy;
  • technical limitations;
  • app store or distribution platform requirements; or
  • changes to ARMTED services.

30. REPORTING A LISTING

Users may report listings that they believe:

  • violate ARMTED rules;
  • are fraudulent;
  • contain stolen goods;
  • infringe intellectual property;
  • involve prohibited items;
  • involve illegal activity;
  • contain materially misleading information; or
  • otherwise create a legitimate legal or safety concern.

Reports should contain sufficient information to allow ARMTED to identify and assess the relevant listing.

Submission of a report does not guarantee removal.

31. DEALINGS BETWEEN USERS

ARMTED does not guarantee the identity, conduct, reliability or legal eligibility of users merely because they have an ARMTED account or listing.

Users should exercise appropriate judgment before dealing with another person.

Users are responsible for independently assessing matters including:

  • seller identity;
  • ownership;
  • authenticity;
  • legality;
  • licensing;
  • payment arrangements;
  • delivery;
  • transfer requirements; and
  • any other relevant transaction risk.

32. NO INSPECTION OBLIGATION

Unless ARMTED expressly agrees otherwise as part of a specific service, ARMTED does not physically inspect every item offered through listings.

ARMTED generally relies on information supplied by sellers and other available information.

Publication of a listing does not mean that ARMTED has independently inspected or approved the item.

33. USER LIABILITY

The seller remains responsible for losses, claims or disputes resulting from the seller’s:

  • item;
  • listing;
  • misrepresentations;
  • legal violations;
  • contractual obligations;
  • failure to disclose material information; or
  • infringement of third-party rights,

subject to applicable law and the ARMTED Terms of Service.

34. RELATIONSHIP WITH OTHER ARMTED POLICIES

Listings may also be subject to:

  • ARMTED Terms of Service;
  • Community Guidelines;
  • Firearms Listing Policy;
  • Listing Compliance Declaration;
  • Copyright and Intellectual Property Policy;
  • Paid Services Terms;
  • ARMTED Partners / Business Terms; and
  • applicable regional or category-specific requirements.

Compliance with this Listing Policy does not replace compliance with any other applicable ARMTED policy.

35. CHANGES TO THIS POLICY

ARMTED may update this Listing Policy from time to time.

Changes may result from:

  • changes to ARMTED categories;
  • changes to listing functionality;
  • introduction of new products;
  • changes in law;
  • regulatory requirements;
  • safety considerations;
  • fraud prevention measures; or
  • changes to ARMTED policies.

The current version and effective date will be displayed at the beginning of this Policy.

ARMTED does not need to issue a new version of this Policy solely because it adds, removes, renames or reorganises categories where the substantive rules applicable to users do not materially change.
